The Winelands Art Gallery Auction App – Terms and Conditions

Welcome to The Winelands Art Gallery Auction’s. By participating in our auctions, you agree to these Terms and Conditions (“Terms”).

General
1.1 These Terms govern your use of The Winelands Art Gallery Auction’s. The Winelands Art Gallery (PTY) Ltd (“Gallery”), registered in South Africa.
1.2 By registering, bidding, or purchasing, you agree to these Terms of use and privacy policy.
1.3 Participants must be 18 years or older and legally capable of entering binding agreements.
2. Registration and Eligibility
2.1 Bidders must register with accurate, up-to-date personal and payment information, including a valid email address and telephone number. The Gallery may request Know Your Customer (KYC) documentation to verify identity.
2.2 The Gallery reserves the right to suspend or terminate accounts for inaccurate details, suspected fraud, or violation of these Terms.
3. Bidding and Purchase Obligations
3.1 Bids are legally binding offers to purchase and cannot be withdrawn except in cases of obvious error or suspected fraud, at the Gallery’s discretion.
3.2 The highest bid at auction close constitutes a binding agreement to purchase the artwork.
3.3 The Gallery may extend, suspend, cancel, or delete bids/lots/auctions if the artwork sells at full price via www.thewinelandsartgallery.com or the showroom, or for any other reason at its discretion.
4. Payment
4.1 Auction prices are inclusive of Value Added Tax (VAT), therefor no additional fees will be added to the hammer price, unless specifically stated under that specific auction lot.
4.2 Winning bidders receive an invoice via email within 24 hours of auction close, detailing the hammer price, VAT, and any applicable fees (e.g., delivery). Full payment is due within 24 hours via bank transfer (preferred) or approved payment methods (credit/debit card on request). Contact auctions@thewinelandsartgallery.co.za if no invoice is received.
4.3 Failure to pay within 24 hours may result in:
- Cancellation of the sale.
- Offering the artwork to the second-highest bidder.
- Blacklisting from future auctions.
4.4 Banking details are provided in the invoice.
5. Delivery and Pickup
5.1 Artworks are sourced from artists or the Gallery’s inventory. Most Artworks are stored securely and are not on display at a showroom, therefor delivery via couriers will take place. If pickup/collection is necessary, we will do our best to accommodate that.
5.2 Pickup requires full payment and prior arrangement via auctions@thewinelandsartgallery.co.za.
5.3 For delivered artworks, the Gallery arranges door-to-door couriers:
South Africa main hubs: R300.
Outlying areas: R400.
International: Quoted on request.
5.4 Delivery typically occurs within 5–10 business days, subject to location. Risk of loss/damage transfers to the buyer upon dispatch.
5.5 Optional insurance is available at checkout (4% of artwork value, minimum R50) to cover transit damage.
6. Artwork Condition and Returns
6.1 Artworks are sold as described in the listing. Customers may rate artist/gallery service (e.g., packaging, timeliness) post-delivery.
6.2 The Gallery is not liable for damage due to poor artist packaging unless insured.
6.3 Returns are accepted only if the artwork is significantly not as described or damaged in transit (with documentation), subject to Gallery approval within 48 hours of receipt.
7. Artwork Authenticity
7.1 The Gallery guarantees artwork authenticity of artworks sourced by the gallery. Digital certificates of authenticity are provided upon request.
8. Intellectual Property
8.1 Artwork images and descriptions remain the property of the artist or Gallery. Unauthorized reproduction is prohibited.
9. Limitation of Liability
9.1 The Gallery is not liable for minor errors in listings, App malfunctions, or disruptions. Liability is limited to the artwork’s purchase price.
10. Privacy
10.1 Personal information is handled per the Gallery’s Privacy Policy.
11. Governing Law and Disputes
11.1 These Terms are governed by South African law.
11.2 Disputes shall be resolved through mediation in Cape Town, South Africa, followed by binding arbitration under the Arbitration Foundation of Southern Africa (AFSA) rules if unresolved.
12. Amendments
12.1 The Gallery may update these Terms without prior notice. Updates are communicated via the App or email.
